1) Media Case Study: Group Oral Presentation
The first assessment will involve students, working in groups of three, giving a short presentation to the class applying the laws of defamation. Each student will be required to give a presentation, though the group will be marked as a whole. The presentations will begin in Week 4 and will be completed in Week 5
The Task
The task is to select, from the print media published in Australia in the period 1 October 2017 to 30 September 2018, an item upon which to base your case study. Imagine that you are in house counsel for the publisher, and have been asked to advise the publisher as a matter of urgency whether or not to publish the item within the next few hours. Your Case Study presentation should take the form of advice to the publisher recommending publication of the item and it should contain BOTH:
1.an explanation of why the item IS defamatory, AND
2.an argument justifying the reasons why it would be LAWFUL TO PUBLISH the item.
So, you have to find an item that is defamatory but which is covered by one or more valid defenses. You must justify your oral answer by reference to the relevant statutes and case law.
• Each group will submit a Bibliography, correctly referenced and laid out using the AGLC, listing all materials used for the presentation
Why a Group Presentation?
This group presentation enables the students to develop collaboration and oral communication skills – essential skills for a graduate lawyer. The purpose of the group work is to achieve both learning outcomes and group processing skills. Students will be collaborating on two aspects:
1. First, they will collaborate on how to develop a persuasive presentation and
2. Secondly, they will collaborate on learning the law of defamation.
Each person in the group will be allocated the same mark, so another skill to be learned is that of effective collaboration so that each member of the group encourages the maximisation of each other member’s effort.
Students are responsible for forming themselves into groups. They are reminded the presentation will take place in tutorials, so all group members must be available to present in the scheduled time in the same tutorial. We will allocate time in the first and second tutorials to do this. You need to form your group by 5.00 pm on Friday 16 August 2019.
In order to facilitate the best results from this group assignment, both in-process and knowledge, your groups will be established in the first and second tutorials and students will design and sign a Charter (available on LearnOnline) that establishes the ground rules for the assignment. Students are to meet regularly to discuss which item to choose for the case-study, to practice the presentation in front of other team members and to engage in feedback on each member’s presentation.
• If any difficulties arise between partners, you should contact the tutor, who will take action to resolve any disputes.
Being able to work in groups is an essential employment skill and so you are encouraged to make the most of the experience. Remember that, whether it is good or bad, it can still become a source of evidence that you can use to show potential employers that you are capable of working in a small group.
The Presentation
Each student will present for five minutes each. The presentation will be a total of 15 minutes and there will be time at the end for your client (the audience) to ask you questions on your advice. Before presenting, each group must give their tutor:
a) The bibliography, and
b) A copy of the article
