In 1996, the Northern Territory became the first jurisdiction in the world to legalise euthanasia. Under the NT legislation, euthanasia became legally available to mentally competent, terminally ill adults who had been examined by three doctors including a psychiatrist. In 1997, the Bill was overturned by the Federal Euthanasia Laws Act. Since 1997, there have been numerous attempts in other Australian jurisdictions to legalise some form of medically- assisted dying, such as euthanasia or physician-assisted suicide. Euthanasia involves the doctor directly administering a lethal medication at the patient’s request, while physician-assisted suicide involves the doctor prescribing a lethal medication for the patient to take themselves. The Victorian Parliament passed the Voluntary Assisted Dying Act 2017. This legalised voluntary assisted dying (physician-assisted suicide) in Victoria from 19 June 2019.
Those in favour of medically-assisted dying appeal to the principle of autonomy, maintaining that individuals should have the right to choose the time and manner of their death. Opponents argue for the sanctity of life and claim that it is wrong for healthcare professionals to use their skills and knowledge to kill rather than to heal.
