Question 3

Brian de Swaart, a citizen of Namibia, has contacted Adelaide. His son, Justin (DOB 1 July 2008), participated in the Mathematics Olympiad in Australia in April. Justin held a subclass 600 visa, and stayed with his aunt, Patricia, an Australian citizen, who lives in Jerrabomberra, which is in NSW, about 45 minutes out of Canberra. He complied with the conditions on his visa and left before it expired. Justin placed third in the competition, which was the best ever result for someone from his country.

Brian says that he has now received a letter from St Edmund's College Canberra, which has offered Justin a scholarship for Years 11 and 12 at St Edmund's for 2025 and 2026. The scholarship is based on Justin's mathematical talents, although the fact that Namibia has an international rugby team didn't hurt either.

Brian says Justin would like to take up the offer, but neither he nor Justin have any idea where to get started. Brian and his wife Justin's mother) Heather are both professionals - Brian is an architect and Heather an orthopaedic surgeon - and are unlikely to be able to take two years away from their practices. Patricia has volunteered to allow Justin to live with her if he comes to Australia. The first language of Justin and his family is English, but Justin has never taken an English test.

Adelaide has asked you to draft a letter of advice to Brian, and address the following

1. What is the appropriate temporary visa for Justin?

2. What are the key validity and grant criteria for this visa?

3. What information and evidence will Justin need to provide to be granted this visa?

4. If either Brian or Heather was able to accompany Justin to Australia, is possible, and if so

what visa should they apply for?

Write a formal letter of advice addressed to Brian discussing the above questions in detail (you should set out each point under sub-headings where appropriate). Your letter should set out your advice, with reference to the legislation and relevant policy (please footnote your references as per the AGLC)
