ASSIGNMENT OVERVIEW

Most hearings before the Immigration Review Board (IRB) are held in smaller, less formal rooms than a criminal court. While all hearings are required to follow the IRB's Case Management Principles, video conference (or online) hearings must also follow the Use of Videoconferencing in Proceedings policy. For this course, we will hold mock hearings in a "virtual hearing room" using Blackboard Collaborate. Everyone will be assigned to one mock hearing. You have the option to act as an observer for the other sessions. Each team will allocate roles within the group. Each team will then decide when to hold the hearing along with your instructor, who will announce the date and time. The instructors will play the roles of the Board Member and the witness. Preparation: To prepare for each mock hearing, you need to do a few things:

1. Figure out how your group wants to divide the roles for the hearing.

2. Copy the forms and documents for your type of hearing from the generic list of documents found under the “Mock Hearings” tab.

3. All group members will receive the same grade for the mock hearing. The mock hearing is worth 15% of your final grade.

 4. In addition to the oral presentation, the group will also complete the Book of Authorities – due one week before your presentation (Assignment 2)

5. Each student is also required to prepare written submissions – due the week after your presentation. This is an individual assignment

Roles – Immigration Appeal Division Hearings

• Appellant’s Counsel – Examination-in-Chief: Your job is to review the material, consolidate a list of relevant questions and pose them to the witness. The objective is to solicit evidence that will support your Theory of the Case. You may need to tweak your questions in the hearing as the Applicant gives different answers. Be prepared!

• Minister’s Counsel – Cross-Examination: Your job is to review the material, spot the weaknesses in the Applicant’s case, take careful notes during the hearing and ask those pertinent questions that will undermine the Appellant’s case. Remember, 90% of the work for cross-examination is done before the hearing.

• Minister’s Counsel – Oral Submissions: You will have to draw upon the evidence, testimonies and the applicable law, and persuade the Board to grant the remedy requested by the Minister. It is up to you to organize your arguments, but generally speaking you are required to explain the applicable legal framework, apply the specific facts to the legal framework and explain why the Board should grant the remedy you are requesting.
