Scenario1
1. Your firm’s existing client, Mr Fabio Bertolli, walks into our office in passing at about 2.30pm on 28 March 2017 with his mother, Mrs Lilueta Bertolli, aged 59. He requests to speak to Ms Broome if she is available (as he and his mother were shopping and in the area), or to otherwise make an appointment in the event Ms Broome isn’t available right at this moment.

2. You go to check Ms Broome’s physical diary and Microsoft Outlook calendar to see if she has any availability at the moment. You see that she is free, so you walk to her office, knock, and inform her that Mr Bertolli and his mother are in the waiting room. Ms Broome advises you to commence the interview and that she will be available to meet them in about 10 minutes.

3. When you ask what the matter is concerning, Mr Bertolli advises that: “it’s sort of got to do with my current commercial matter with you... you know my existing matter – the setup of the joint venture business”. He says that he needs his mother to sign a guarantee document for his new business and that his mother has agreed to do so. However, in order to sign the document, apparently the bank informed his mother that she must seek independent legal advice. So he has come to us.

4. During the meeting, you note Mrs Bertolli’s language skills are very limited, she only nods at you and does not seem to be following any of your conversation.

5. You identify that an interpreter is required as Mrs Bertolli does not indicate full and comprehensive understanding of her responsibilities and the terms and conditions tied with her signing the guarantee document. However, Mr Bertolli, our client, wants to be the interpreter and does not see the need to bring in a third party to the meeting.

You will role play the above meeting. Prepare a script for your role play of the meeting to be submitted to your trainer at 9am of the assessment/ role play date. Ensure you have 3 copies (1 for yourself; 1 for your partner and the other for your trainer). Your script must be based on the scenario above.

Task 2
Conduct the meeting according to your script (role play). When commencing the role play with Mr and Mrs Bertolli, consider Section 6 of the B&B Policies and Procedures Manual and be mindful of others in the waiting room. Ensure you make reference to this in your script. Your script should include indicators of environment and setup of meeting place/room.

From the scenario and from reading paragraphs 1-3 only, what issue can you identify that may breach ethical/professional standards. Record you answer in a file note
