Highlights
You just got a new job working for Long Cove Outdoors Inc. (“Cove”) as an HR assistant. You will be working with the Manager, Bob Jumanji.
Mr. Jumanji has provided you with a precedent termination package (located on Moodle and includes a termination letter and its attached Release Agreement). These documents were created by the company’s lawyer. However, they require the drafter to make choices of what to include, subject to the legal requirements (laws) that affect each employee, based on their individual situation. The documents provided to you were used to draft a termination package for a previous employee (and may contain some of the changes made for that individual employee). You will need to amend it for what’s appropriate for Quinn Hughes. As a result, you must make changes to names, etc., as well as determine the appropriate options (e.g. related to how much notice and what types) for the employee you will terminate (based on how the law applies to him/her).
It goes without saying that the information in this email is confidential and should not be shared with anyone but me. This morning we terminated the employment of Quinn Hughes, a 23-year-old Repair Technician, living at 1235 Berkley Street, North Vancouver B.C. V7L 2I8. Quinn did not do anything wrong; we just cannot afford to keep him. I would like you to prepare a termination package that I can send to him. I should be able to use it as is, without needing to make any further changes, so please make sure to completely fill out the required information, make appropriate changes to the dates, etc. and make sure all notes in the draft have been deleted, and the document has been proofread accordingly.
1. Today we gave notice to Quinn Hughes indicating his employment will be terminated.
2. We want to send him a letter tomorrow to provide him with a termination package offer and give time to get independent legal advice.
3. Quinn began employment with us on January 1, 2016.
4. Quinn’s employment agreement states that in the event we terminate him without cause, he will be entitled to notice equal to the minimum allowable, according to his years of employment, as listed in the B.C. Employment Standards Act. It is our intention to provide him with working notice to fulfill our statutory obligations, as he wants to finish some of the projects he has been working on. Therefore, you will see him at work during this time, beginning tomorrow.
5. In addition, in return for signing our attached Release Agreement, we have negotiated that we will also provide Quinn with a lump sum payment equal to reasonable notice, as calculated according to the common law. We feel this is the correct thing to do for a good employee and want to be protected against any potential future lawsuits. You will need to determine this amount, based on your experience with employment law requirements, and the information contained in this letter.
6. Do not add anything new to the termination package other than what is required. This is the precedent our lawyer has drafted.
