The brief

1.1 Among the most commonly used consultancy contracts in New Zealand are those found in the Engineering New Zealand.
1.2 Read both the contracts titled Short Form Agreement for Consultancy Engagement (SF) and the Long Form Agreement for Consultancy Engagement (LF).

1.3 Prepare a report for Engineering New Zealand that critically reviews the LF addressing the following:

(i) The extent to which the contract complies with modern plain language guidelines using the Plain Language Compliance Checklist found in the attached document titled: ‘Plain language drafting guidelines - Naseem April 2022’

(ii) Re-write one of the following clauses from the LF to demonstrate a ‘before and after’ example of how some of these clauses may be re-written in modern plain language. Choose only one from any of the following:
a.    Clause 2:        Obligations of the Consultant,
b.    Clause 3:        Obligations of the Client,
c.    Clause 7:        Variations,
d.    Clause 11:      Termination, or
e.    Clause 12:      General Provisions

(iii) The extent to which the LF is a fairly balanced contract between the client and engineering consultant

(iv) The extent to which the LF is suitable for smaller engineering consultancy projects

(v) The need for or otherwise for two consultancy contracts (the LF and the SF) as opposed to a single one
