You are required to read the following scenario:  
Tim is a 32 year old man who was admitted via the emergency department following a fight at a weekend football  match he attended as a spectator. A physical examination revealed a dislocated shoulder, deep scalp lacerations and  extensive bruising to his face and upper body. The emergency department was very busy, with multiple ambulances  arriving and many patients being admitted, therefore, it took some time for Tim to be admitted for surgery. During this  time an alcohol and drug screen was undertaken, and these tests were clear. Tim did not like waiting and he stated he  felt unwell and drowsy. He became increasingly noisy and uncooperative, which was a change from when he arrived; at  that time, he was lucid and polite. Tim was fasted, went to the operating theatre and returned to a room on the ward.  On waking, Tim’s observations were stable, although the nursing staff had difficulty doing his postoperative  observations as he was drowsy and noncompliant. Two hours after surgery Tim stated: “I’m going back to the football  match because my team need me to play”. The registered nurse and medical officer on duty tried to persuade Tim not  to leave but he continued arguing and shouted: “Leave me alone, don’t touch me, I want to get out of this bed”. The  doctor thought that perhaps this behaviour may be attributed to pain and as a result ordered intramuscular morphine.  Tim stated: “I’m not in pain, I don’t want morphine”. The registered nurse went ahead as per the medical officers  orders and administered the injection to Tim, whilst another registered nurse and a nursing assistant held Tim to  prevent him from struggling. This caused the needle to break off, and necessitated further surgery, which resulted in an  additional four weeks in hospital.
Your overall aim is to demonstrate to the marker your understanding of the unit content (legal and ethical issues,  including the Registered Nurses professional codes and standards) by relating them to the specific and relevant  elements of the scenario. To do this you will provide an analysis: a detailed examination. DO NOT REWRITE THE  SCENARIO, rather your discussion should be focused upon the unit content. Use the applicable parts of the scenario as  a basis to demonstrate your understanding of the unit content e.g. beneficence, deontology, duty of care, tort of  negligence, Registered Nurses Standards for Practice, The ICN Code of Conduct for Nurses etc. The word limit is 1200 (plus or minus 10% as per the School of Nursing & Midwifery Undergraduate Assignment  Guidelines). All words are calculated towards the word limit except for the title page, direct quotes and end-text  references. If you write less or more than this, penalties will apply. If you write less, it is unlikely you will have covered  all aspects of the assignment.   
The assignment will be marked using the School of Nursing and Midwifery standard marking rubric, which you will find  on the unit Blackboard site. Content  
You need to consider:  
• The use of an ethical decision-making framework to plan your work (see week 1 tutorial presentation for an  example). 
• The relevant unit content, ethical and legal/professional concerns (introduced and discussed throughout the  unit up to and including week 5), that the scenario raises.  
• The possible actions or inactions/omissions that occurred, focusing on the implications from a legal and ethical  perspective. Which ethical, principles, doctrines or concepts apply to the actions/inactions put forward and  how? Do any ethical theories support, or do not support those actions/inactions? Which torts or other legal  concerns apply to your identified actions/inactions? 
• Do any of the ethical theories or principles conflict with each other or with the law? If so, discuss from both  perspectives. 
• Linking the application of Registered Nurse professional codes and standards to the relevant areas of your  discussion to create in depth analysis. 
Application of critical thinking  
You will be assessed on your ability to consider the implications of the identified actions/inactions, the quality of the  application of theory (unit content) to practice and the quality and depth of your analysis. You will also be assessed on  your ability to support the arguments you put forward with evidence from appropriate literature, including the quality  and relevance of that literature. 
There is a minimum of 8 references required, although you should read widely and incorporate that reading into your  assignment! The more you read, the more evidence you will find to weave into your essay and support your ethical and legal claims. References for this essay should be within 5 years of publication only. References should be from a valid  source (peer reviewed journals, government and official health organisation and professional online websites and  resources e.g. Department of Health, Nursing and Midwifery Board of Australia etc., books) and all must be relevant to  Australia. References should support the ethical and legal/professional information as oppose to clinical information. Do not leave areas in your work that are unsupported by evidence. As a rule, each paragraph should include a reference to support your discussion within that paragraph. 
Check the similarity report and ensure that you have paraphrased information and provided a reference. 
Structure & presentation 
You should follow the School of Nursing and Midwifery Guidelines. 
There is no need for headings: the paper should flow in one long sequence. See SNM assignment writing guidelines for  layout. 
You need to develop a logical piece of writing that shows the possible legal and ethical implications of the care provided  or omitted as the case may be. 
The main part of the assessment is that each of those areas (ethics and law) contains relevant and appropriate material. Your introduction should succinctly introduce what will follow (no more than 10% of your word count). The main body should contain a logical and cohesive development of ideas and demonstrate your ability to develop a logical discussion. 
Your conclusion should provide a summation of the key points of the work (no references in the conclusion). Full sentence structure is required.  
Do not rewrite the scenario. Refer to the relevant parts of the scenario as you discuss the relevant ethical theories, concepts, principles, legal and professional elements of the unit content. 
Referencing  
You must comply with the ECU SNM assignment writing guidelines, these specific assignment instructions and use the  ECU referencing guide to ensure all in-text and end-text references are correct. Please use the School of Nursing and  Midwifery Assignment Guidelines and the ECU Referencing Guide to present your work. As with all written assignment work that you undertake at ECU, you will be assessed for ELP within this assignment.  NUM1205 is not a prescribed unit for ELP, so the weighting against this criterion is not as high as in the prescribed units.  However, you should make every effort to ensure that you pay close attention to the construction of sentences,  ensuring spelling, grammar and syntax are correct. Poor writing will detract from the content of the essay if you are unable to articulate the true meaning that you are  trying to convey, and this may lose valuable marks.
