Write a 1500 word essay, discussing the legal and ethical issues that arose in your chosen scenario.

The task is to discuss the legal and ethical issues that arise in your scenario, with consideration to be given to duty of care, professional practice standards, mandatory reporting and any other relevant law or regulation that has been discussed in this unit of study.

Consider the ethical dilemmas for the nurse as well as how other stakeholders have been impacted. In doing so, you must apply and demonstrate an understanding of one of the decision making frameworks covered in this course, with a justification for the model you have chosen.

Finally, please include a personal reflection on the issues, reflecting on how what you have learned from this scenario might be included in your future practice.

Assignment 1 Scenario 1

Nurse Jackie worked as a registered psychiatric nurse at the Latrobe Regional Hospital (LRH) in the Community Residential Care Unit between July 2018 and April 2020. In February 2019 Nurse Jackie became regularly involved in the care and treatment of patient X. They built a rapport and in January 2020, while still under Nurse Jackie’s care, they started a personal relationship.

The patient’s vulnerability, with a background of family violence and childhood trauma was well-known to Nurse Jackie currently.

The relationship continued until July of 2020 During this time, Nurse Jackie and patient X had regular personal contact, attended social activities together and with patient X’s children, posted photos on social media, personal text messages (using false names), and a sexual relationship.

As a colleague, you are friends with Nurse Jackie on Facebook and notice some of the photos of patient X with her in social situations.

You approach her at work one day and mention you have seen the photos and express your concern that she is seeing a vulnerable patient outside of work. She claims that the friendship has ceased, and they are not seeing each other.

However, in August of 2021 patient X reported the relationship to the Nursing Unit Manager in the outpatient’s department when attending an appointment. An investigation, found that the relationship had not ceased when Nurse Jackie claimed it had and was now harassing Patient X, asking for them to move in with them.
 

Assignment 1 Scenario 2

An experienced nurse, Nurse Z on your ward, had been occasionally showing up to work clearly under the influence of alcohol. She mainly worked night duty and had worked at the hospital for 15 years. You know she has a turbulent home life and abusive marriage.

She is liked by many of her nursing colleagues who often look out for her regarding picking up her slack at work, covering for her mistakes, and sometimes even putting her to sleep in a spare hospital bed or quietly sending her home when she was too drunk to complete her shift.

You are a junior nurse working on this ward and are feeling very uncomfortable about what is happening. Your workload is increasing as you often need to take her patients and Nurse Z is often on night duty with you, leaving you alone to manage the patients, when she sleeps.

You mention your concerns to one of your colleagues who tells you not to mention it to the NUM as she will lose her job, and that you have to stick together.

You notice a change in the way other members of staff are treating you. They don’t sit with you at lunch and don’t invite you to activities outside of work, which they were doing before, and often see them talking together and when you get close they stop talking. You sense they are gossiping about you.

Last week, Nurse Z came to work intoxicated and made a significant medication administration error that caused a patient’s death. Her impaired condition and alcohol problem could no longer be hidden and came to light in the worst of circumstances. The NUM reported a complaint for the medication error, impairment, and patient death.

The NUM asks to see you in her office, where she asks you why you had not mentioned that Nurse Z was intoxicated when working with you on that shift and that this had put the patients at risk.

Assignment 1 Scenario 3

Taylor is an experienced registered nurse. She has been working at an aged care facility for five years as a nurse in charge. She is well liked by staff, residents, and families.

Carmel, a 70-year-old resident, sustained brain damage following a motor vehicle accident several years ago. Consequently, she has no comprehension of financial matters, she also has memory loss and can get confused at times which causes her to be upset and anxious. She can feed herself but requires help with all other activities of daily living.

Carmel does have a daughter who rarely visits her and the relationship seems quite fractured, and Carmel states she is a little scared of her temper.

Taylor decides to become Carmel's financial advisor and has Carmel sign a power of financial attorney to enable access to Carmel's bank accounts on the pretext of helping Carmel.

Taylor goes to Carmel's bank and withdraws $20,000 and uses the money to pay Taylor's outstanding bills and for a holiday.

You are working at the aged care facility as a new qualified registered nurse.

You overhear a phone conversation at the nurses’ station where Taylor appears to be talking to her partner telling them to stop yelling and that she will get the money for them as soon as possible and that she has ways of doing that in her role. This concerns you but think this is none of your business so continue with your work.

The next day you are looking after Carmel. You walk in the room and Carmel is with someone you don’t recognise, who says she is her daughter Sandra. Both Carmel and Sandra are very upset as they have discovered that Carmel’s bank account has had a large withdrawal and Carmel doesn’t not know where it went
