There are three questions in this assigment, please answer ALL questions. Question 1 (7 marks): 
Phoebe offers Shelley part time cleaning work for $10.00 per hour. Shelley says she wants $15.00 per hour. 
Phoebe says: ‘I’ll give you $12.00 per hour’. Shelley responds by saying: ‘Give me $15.00 and I’ll bring my own cleaning products.’ 
Phoebe says: ‘OK but what kind of products do you use?’ 
‘I use Domestos, Ajax, the usual range’ replied Shelley. ‘Oh, no’ cried Phoebe ‘I can only have environmentally friendly products used in my home. $13.00 per hour and use my products. Take it or leave it.’ 
Shelley looks doubtful. ‘Come on,’ says Phoebe ‘If I don’t hear from you by 5pm, I’ll take it that you’re OK with that and expect you tomorrow morning.’ 
At 5:01 pm is there an agreement between Phoebe and Shelley? 
Question 2 (4 marks): 
Nathan agrees to wash his father’s car on a weekly basis for six months in return for his father’s promise to pay him $10.00 per wash. Nathan washes the car for the first three weeks but his father tells him that he cannot afford to pay him. Nathan now wants to sue his father for breach of contract. 
Would the agreement have been supported by the necessary intention?
Question 3 (7 marks): 
John purchased a small cafe from Phillip. John was induced to buy that business by a statement by Phillip who said the average takings were $2,000 per week. Two weeks after taking over the business it became apparent to John that the shop took no more than $750 per week. Phillip’s statement must have been made knowing it to be false. John wants to return the business and recover the purchase price. 
Is John likely to be successful? Explain your answer fully.
