Your firm is acting for Intu SGS, the retail shopping mall landlord, to provide property management consultancy advice for the Victoria Shopping Centre in Nottingham. You are to assume that Unit 70 in the Victoria Centre is currently vacant but is held on a lease which is shortly due to expire.

The Tenant of Unit 70 has a poor credit history and has been paying rent at a reduced level for the last two years under a CVA (Company Voluntary Arrangement) with Intu. All the signs seemed to indicate that the lease would simply come to its natural end and your client was therefore very surprised to receive a s.26 notice from the Tenant requesting the renewal of the lease.

Your client has instructed you to oppose the s.26 notice on their behalf. Set out your advice to Intu in clear terms and prepare any associated documentation (to be included in the appendix).
