You are a police officer with the Queensland Police Service (QPS). You and your partner have attended a call out for assistance at a residential address. Once you are there, you see an elderly male smoking what appears to be a marijuana joint. You overhear the daughter say that he is terminally ill. Your partner, who is just new to the service, pulls you aside and says, ‘Let’s leave the old man be, he’s not doing any harm to anybody else. Besides, he probably won’t be around long enough to hear the outcome of the trial if we charge him, let alone serve his time.’ 
Under Schedule 2 of the Drugs Misuse Regulation 1987 (Qld) marijuana is classified as a ‘dangerous drug’. Section 9 of the Drugs Misuse Act 1986 (Qld) makes possession of a dangerous drug such as cannabis a crime, with a maximum penalty of 15-20 years imprisonment. 
Please note that for the purposes of this scenario the elderly male does not have approval for medical cannabis.

1.    Explain the theory of ethics you would be applying if you do apprehend the elderly man and why.

2.    Explain the theory of ethics you would be applying if you do not apprehend the elderly man and why.

3.    Imagine you have not apprehended the elderly man, and then address the following questions.

a.    Analyse and discuss whether you complied with the QPS SELF Test (HINT: Ensure you outline and then answer all questions in the SELF Test and explain why the test would or would not be met in the circumstances).
b.    Outline some of the possible consequences of your unethical conduct, how would this reflect on the QPS.
c.    Explain the alternative actions that could be taken in order to avoid/resolve this ethical problem. How would you set a good example of the desired ethical conduct?
