Side and rear setbacks focus on providing separation between buildings. This can be found in the Building Regulations 2018 BCA Part 5, Division 2, Registration 79. There are different aspects of this regulation that focus on different factors. These factors include the height of the wall and the neighbor’s property. 12 Boyd Ave, Shepparton is a Class 1 building in the Greater Shepparton City Council area. I chose this specific building since it has 2 different types of setbacks.

The setbacks start from 1m away from the boundary when the wall is 3.6m high if it is any higher the distance between the boundary and building increases. The minimum distance is 1m since if it was any smaller space wouldn’t be functional and it would be considered ‘dead space’.  There are instances where the building is built on the boundary if they see it fit. So, there are 2 options:

  • Build at a minimum of 1m away from the boundary.
  • Build it along the boundary.

To build 1m away from the boundary is simple since it follows the regulations there isn’t much that could complicate the building process. There would only be complications if the design doesn’t follow the diagram above. 
In the chosen property the rear and east side setbacks follow the regulation. The wall height is 2.7m which indicates that the distance between the boundary and the structure can be from 1m onwards. In this particular site they have chosen the setbacks to be 2 and 2.04 m in distance. 

Buildings directly on the boundary, however, are different this regulation follows more to regulation 80. One of the criteria is that the wall can be directly on the boundary or within 200 mm of the boundary, both of these are considered on the boundary. When building on the boundary you need to follow a simple rule: you can build on 10m of a wall with an addition of 25% of the remainder of the property length [x-104=y+10=Ans]. These are along one side of the boundary; in this regulation all the sides of the boundary are looked at individually. 
The west side wall for the chosen building is directly on the boundary. The wall itself is 6m long so it is under the maximum wall length. If it was proposed the wall could extend to 12.35m since it follows the above equation [19.6-104=2.35+10=12.35].

There are instances where the wall can encroach into the setback these can include the following:

  • Landings with an area of not more than 2m2 and less than 1m in height.
  • Unroofed stairways and ramps. 
  • Pergolas.
  • Shade sails.

The reason behind this is because these aren’t objects that would decrease the practicality of the space, as a matter of fact, it would enhance it. Providing shade or more levels in these areas opens up different ways to use this space more efficiently. This, in the end, would provide a better outcome.

However, some specific wall can only encroach 500mm into the setback:

  • Porches and verandas.
  • Masonry chimneys.
  • Sunblinds.
  • permanent and fixed screens referred to in regulation 84(5)(d) or (6).

the building is opposite an existing wall built to or within 150mm of the boundary; or 
the  setback will  not  result  in  a  significant  impact on  the  amenity  of  the  secluded  private  open space and habitable room windows of existing dwellings on nearby allotments; and 
the  setback  is  consistent  with  a  building  envelope that  has  been  approved  under  a  planning  scheme  or planning permit and or included in an agreement under section 173 of the Planning and Environment Act 1987; and 
the setback will not result in a disruption of the streetscape; and 
the setback is consistent with any relevant neighborhood character objective, policy or statement set out in the relevant planning scheme.
