Client Instructions Rex is a wealthy retiree, with three adult daughters, Goneril, Regan and Cordelia.

Goneril recently engaged Happy Home Constructions Ltd (HHCL) to build her a new home, but she was rapidly running out of funds to complete the project. She asked Rex for a loan, just for the purpose of finishing the house. So Rex opened a special bank account with Megabank Ltd, in Goneril’s name, and deposited $200,000 into it. Rex said to Goneril: ‘This is to be used only for the purpose of completing the home. If there is any surplus in the account when you have finished the project, I want it back.’ Before Goneril had drawn any amounts from this fund, she was declared bankrupt, owing HHCL $100,000, and various other creditors more than $200,000 in total. The Official Receiver has now claimed the funds in the Megabank account, and intends to use the fund to pay all creditors, pari passu. HHCL claims that it is entitled to claim $100,000 from the account in priority over other creditors. Rex wants the fund returned to him, since Goneril is now not in a position to complete the home building project. Regan is the mother of 5 year old twins, Pixie and Dixie. When they were born in 2016, Rex wanted to be sure that the twins would be able to afford a university education so he decided to settle some investments on trust for them, in the Twins’ Trust. He appointed Regan and her husband Frederick as trustees, and executed a trust deed which included the following terms:

1. Until such time as Pixie and Dixie attain the age of 18, capital and income shall be preserved in the fund.

2. Upon their 18th birthdays, the fund shall be distributed equally among them. On 4 May 2021, Regan received the shocking news that Frederick had died suddenly of a drug overdose. She has since discovered that Frederick (whom she trusted to manage the Twins’ Trust) has sold trust assets and withdrawn the following amounts:

• $200,000 to gamble unsuccessfully at a casino.

• $900,000 to purchase a studio apartment in Kings Cross, in the name of a person named Bella Donna. The studio apartment is now valued at $1.2 million.

• $40,000 to pay life insurance premiums on a life insurance policy on his own life. Investigations have revealed that Frederick paid the first $10,000 insurance premium from his own funds. Bella Donna was named as the beneficiary of the life insurance policy.

The insurance company has informed Regan that the pay-out from this insurance policy will be $2 million. In 2018 Rex paid $600,000 to buy his daughter Cordelia an apartment in Pyrmont to live in while she was a university student. He said to Cordelia, when the apartment was purchased, ‘I am registering this in your name, because I don’t want to have to pay land tax on it, but once you graduate and have a well-paying job of your own, I will ask you to sell it, and return the proceeds to me.’ Cordelia was happy to agree to this arrangement at the time. In 2020, however, Cordelia entered into a relationship with Luther and allowed him to move into the apartment with her. Luther said to Cordelia, ‘Your father is never going to need the money from this apartment. Anyway, he has given plenty of money to your sisters over the years. This apartment is too small for the two of us. We should sell it now, and buy something bigger, somewhere much nicer.’ So, somewhat reluctantly, Cordelia agreed to sign a memorandum of transfer and the apartment was sold for $800,000. Luther then used the proceeds as a deposit on a $2 million house in Neutral Bay. The Neutral Bay house was registered in Luther’s and Cordelia’s names as tenants in common, and Luther took out a mortgage over the Neutral Bay house in his own name for the remaining $1.2 million purchase price. Rex has now discovered this and is furious. Rex now seeks your advice on the following questions:

1. Can Rex successfully claim the $200,000 in Goneril’s Megabank account?

2. Can any of the funds dissipated by Frederick be recovered for the Twins’ Trust?

3. Advise Rex of any claim he may now bring against Cordelia and Luther in respect of the Neutral Bay house which he estimates is now worth closer to $3 million after recent property price rises.
