TASK 2
• Remember that if you say your name, your name is Sam Hopkins.

• You only have 2 minutes so you need to make sure you focus on the relevant material only. This means that you should not discuss the difference between terms and representations, for example. You should not discuss in depth whether misrepresentation took place (as the information provided confirms that it has). Your job is to introduce yourself, set the scene (say that this is a case of misrepresentation and that the definition of misrepresentation has been satisfied  - but only very briefly comment on this), then say what the purpose of you speaking is (to advise on the most appropriate type of misrepresentation for the client), then give your advice (your advice is likely to be focussed on negligent misrepresentation under the Misrepresentation Act 1967 – remember that the remedies available will dictate why you chose the type that you did).

• You will obviously have to record yourself through your phone, camera or laptop. A guidance document on how to do this and what to do if you don’t have access to these things will be provided in due course. You must record a video. If you only record audio, then the recording will be marked (but you will lose marks for presentation).

• Dress smartly. You are a trainee solicitor in a big firm. This is a professional context.

• Re-record. This Task is not live. Therefore, you can re-record the video until you get it right.

• You are permitted to edit the video if you wish (although this is not recommended as the video must mimic a conference call. So, if you have edited a lot of cuts and the breaks are noticeable, you will be marked down for not following the instructions).

• The word count for this task is calculated by assuming that 1 minute = 100 words. Therefore, since you are permitted to exceed the word limit by 10%, you are permitted 2 minutes 12 seconds for this Task. I can advise that you will not be penalised for going up to 2 minutes 30 seconds. However, any more than this will incur a penalty (the specifics of which is stated in the initial pages of the Portfolio Brief).
