Jenny Ledger rents a two-bedroom apartment in Parramatta CBD. Michael Young lives in the apartment next to Jenney. Their adjoint apartments have a common wall. The two apartments are rented from the same owner, Adam Quan. Both Jenny and Michael have lived in their respective apartments since 2018. Jenny is a freelancer, working mostly for a small-sized Film Studio located at North Sydney. Jenny oversees the production and postproduction of short films and documentaries, which involves watching raw footages in order to cut scenes, insert transition effects and work with voice and sound effects. Jenny often has people coming from the Studio to her place to watch film footages or to discuss art effects and other matters. Michael is an electric guitarist who works with a Blues/Jazz group in the evenings and practices at home during the day. Jeff Blakely is the building manager who also resides in the same apartment block. Jeff assists with the day-to-day running of the building. His duties include ensuring the maintenance and repair of common property, overseeing security and cleaning, controlling the use of common property by tradespersons and other non-residents. Both Jenny and Michael have repeatedly complained about each other to the building manager, Jeff, and the landlord Adam. Michael complains about the constant noise from Jenny’s TV and sound system. Michael has also called the police on numerous occasions complaining about noise from Jenny’s flat and the police have visited both apartments on previous occasions. Jeff has also been concerned about the constant coming and going of people from Jenny ’s apartment. Jeff has attempted to discuss with Jenny and Michael separately, but they do not seem to be available for, or open to have, a conversation. Since the Covid pandemic from early 2020, many tenants have started to work from home more often. Jenny and Michael also had more arguments about the noise. While lockdown is imposed, Jenny doesn’t have visitors, however, other tenants have noticed that Jenny constantly has visitors during all other times. While that is legal, other tenants find it concerning during such a time. Jeff has received various complaints from residents about the noise from both Jenny and Michael’s apartments and visitors to Jenny’s apartment. Jeff escalated the matter to the owner, Adam Quan. Adam is tired of such difficult tenants and, after phone discussions with Jeff, decided to give both tenants an ultimatum to sort out their problems without disturbing him. Otherwise, Adam warns them, he might have to order them to move out within a month. Adam has a niece who lives overseas and is planning to relocate to Sydney to study and possibly rent one of his flats. Adam would prefer to rent out his apartments to his niece rather than having to deal with these constant complaints from the tenants. He is also uncomfortable with Jenny using the flat for business meetings. After weeks of complaints, exchange of emails and heated phone calls, Jeff has now proposed that they attempt an amicable discussion and possible agreement through mediation. An online mediation session is scheduled with the agreement of all parties.
