Melbourne Magistrates’ Court – 23 August 2021 – Contested Hearing

Our Senior Partner, Harvey Spencer, appeared on your behalf before Magistrate Smith at the Melbourne Magistrates’ Court on 23 August 2021 for the first mention of your matter. You were excused from attending.

Mr Spencer entered into negotiations with the prosecution, arguing that the charges should be withdrawn on the basis of your instructions and the limited evidence available in the preliminary brief. Police refused to withdraw the charges without time to gather further evidence. When the matter was mentioned in court, Mr Spencer argued that it should be adjourned directly to contested hearing. Magistrate Smith accepted that argument and, in accordance with your instructions, the matter was adjourned.

1. NEXT COURT DATE

It is now listed for a half-day contested hearing at the Melbourne Magistrates’ Court on 23 August 2021 at 10:00am. All prosecution witnesses shall attend to give evidence, and we ask that you arrive at Court no later than 9:00am.

In the meantime, we have received the full brief of evidence, which contains the documentary evidence police intend to use to prove the charge against you. A copy of the brief is enclosed for your reference.

2. THE CHARGES AGAINST YOU

You are charged with three counts of Theft of one Tissot gold watch to the value of $850, Swarovski crystal earrings to the value of $399, and a ring to the value of $499. The items have a total value of $1,748 and is property belonging to Myer Stores Pty Ltd. The offence occurred at approximately 8:20 pm on 17 April 2021.
