SepahTu, a world-famous comedian, has agreed to perform at Maharaja Lawak Super Club in  Cardiff from the 1st February until the 1st March 2020. A term of the contract provides that  ‘SepahTu will not perform at any other venue for the duration of the contract’. Lee Bong Soon,  owner of Maharaja Lawak Super Club, discovers that SepahTu had perform at the Millennium  Centre in Cardiff on the 15th February 2020. Lee Bong Soon contacts SepahTu and to inform him  that, the act of performing at the Millennium Centre is amounting to breach of contract. 

Required: 

Advise SepahTu on whether he had breached the contract. What action can be taken by Lee Bong  Soon against SepahTu. 

QUESTION 2 

Amin has purchased a house and promised to transfer his right of ownership of the house to his  first wife, Juliana, after the completion of all installment payment to the bank. The promise was  recorded in writing. However, when payment had been completed, on the persuasion of his mother and sibling, refused to fulfill his promise to transfer the house. Juliana wants to take legal action  against his husband for breach of contract.  

Required: 

Advise Amin and Juliana under the provision of contract law.

Martin purchased an orange juice from Hungry Sdn. Bhd. through a vending machine owned and  maintained by the company. Upon drinking the juice, Martin suffered from diarrhea and  subsequently was admitted to the hospital.  

Required: 

Advise Martin whether he can take any legal action against Hungry Sdn. Bhd.

Dayana sold a car to Hafiz, the car was purportedly registered with the JPJ Pahang. The said car  was later seized by the police. It was found to be a stolen car, and its registration card had been  forged. Hafiz want to sue Dayana for the refund of the car.
