The Scenario:
The River Bank precinct where the Regency Grande Hotel is located, is undergoing a significant redevelopment. An opportunity for the hotel to expand into the new “Riverwalk area” overlooking the Torrens River and Adelaide Oval, has been given approval by the Executive Management Team. The new facility will be accessible from the Riverwalk promenade (and not via the hotel itself) and will operate as a separate entity, managed by the Regency Grande.
The Assessment Task:
Prepare a Compliance Manual for the new 60 seat food and beverage outlet. The manual will be used by the leadership team within the Regency Grande to ensure the new food and beverage outlet will meet all the local, state andfederal compliance requirements required for a successful operation.
The manual will be a step by step guide for the current management team to follow, as they prepare for the opening of the new, as yet, unnamed outlet. If the new offering is profitable, the Regency Grande may consider replicating the concept in other areas of the city and state. The compliance manual would then be used by those future operators to ensure their new business meets all regulatory requirements.
Note: Please ensure the context of the situational learning model is used to frame your responses to the questions below. For example, if a response requires you to identify personnel for communication purposes, or staff who are responsible for completing a compliance task, ensure the staff identified would be reasonably found in a hospitality/tourism/event work environment.
1 Using the table below identify and list a range of possible Internet sites, industry sources, etc. that the new outlet management team (OMT) could regularly access for compliance information. The list will cover (but not be limited to):
1.1 Business structures/statutory regulations
1.2 Business specific licenses e.g. liquor, gambling
1.3 Insurance
1.4 Industrial relations/EEO/NES etc.
1.5 Taxation
1.6 Consumer rights
1.7 WHS
1.8 In addition to the responses to question 1, provide the OMT with at least list ten (10) non-internet based sources of information and advice on regulatory compliance for future readers of the manual. Provide recommendation to users of the manual other methods of maintaining knowledge of current regulatory requirements.
2. Review the business requirements for the new outlet: new name, liquor license etc., and the responses to:
2.1 Identify the scope of the compliance required.
2.2 Create a table for the OMT that identifies if the compliance initiatives (1.1 -1.7) are required by local council, state government or by the federal government.
2.3 Identify the specific area of the business against the compliance requirement. i.e.: is the liquor licensing local, state or federally controlled?
2.4 Include in your table, a column that displays the file path of where electronic copies of scanned business licenses maybe found on the hotel’s administrative share drive.This will allow the OMT to access copies of licences for audit purposes quickly and easily.
3 Choosea compliance regulator and email, or visit the centre, to obtain specific advice/documentation/forms etc. for the compliance requirement.
3.1 Complete these documents/forms (using the Regency Grande as principal operator) as examples for the OMT.
3.2 Includeboth the blank, and the sample completed forms, in the appendix of your manual.
4 From the table in question 2, review compliance requirements for Liquor Licensing and WHS.
4.1 Identify for the OMT the penalties and consequences to the business of this non-compliance in the 2 areas.
Food business licence-
• The penalty for handling food in a way that makes the food unsafe or unsuitable, and/or selling it, is $40,000 for an individual or $200,000 for a corporation.
• Under the Food Act 1984 it is an offence to operate the food premises without registration.
• If there is no responsible person at the site there are penalties for that too : $40,000 for an individual and $200,000 for a corporation.
