The scenario Quentin and Elliot are brothers in their early 20s and they live together in Armidale NSW. Elliot is unemployed and has struggled with addiction issues for a number of years while Quentin, the younger of the siblings, pays the rent and utilities and does everything around the house. One evening in March 2019, Quentin returned home on a Friday after work accompanied by his friend Julia. They were planning to have a night in and order pizza and watch some movies after a busy week. Upon entering the living room they found Elliot sprawled across the couch surrounded by empty beer bottles and next to a syringe, spoon, and cigarette lighter. His left arm bore telltale signs of a recent heroin hit. When Quentin turned the light on, Elliot groaned and mumbled something incoherent. Angry at Elliot and embarrassed in front of Julia, Quentin turned the light off and walked back out. Concerned by what she had just seen, Julia asked Quentin whether Elliot was okay and suggested they try and help him. Quentin was dismissive, replying “I’m sick of dealing with his issues - he’s a lost cause. Go to my room and choose a movie, I’ll deal with him”.  Quentin left a glass of water next to Elliot and then he joined Julia in his room to order pizza and watch a movie. A couple of hours later, Margo, Elliot’s girlfriend, came over to see Elliot. Margo and Elliot had been together since high school and she remained devoted to Elliot throughout his struggles with substance abuse. Margo entered the living room to discover Elliot dead, having overdosed on heroin and alcohol earlier that evening. Hearing her panicked call to 000, Quentin and Julia rushed into the living room and upon seeing Elliot, Julia said in a shocked whisper “oh my god, I knew we should have called an ambulance”. Margo, sobbing, turned around with fury in her eyes and screamed at Quentin “You knew he had overdosed and didn’t do anything?! You callous bastard – he’s your brother. You have always been so selfish and heartless. You deserve to die, not him!” In her rage, she grabbed a heavy glass paperweight from the coffee table and hurled it at Quentin. Quentin swerved out of the way, knocking into Julia who stumbled over an empty beer bottle on the floor before being hit square in the temple by the paperweight, rendering her unconscious. By the time the paramedics arrived, Julia was dead. Autopsies later determined that the paperweight blow had ruptured an artery in Julia’s brain and that if Elliot had received medical intervention earlier in the evening he would have lived.
