The burning of fossil fuels like petrol releases various ‘greenhouse’ gases, in particular carbon dioxide (CO²). There is worldwide concern that increasing levels of CO², building up over decades in the global atmosphere, is contributing to increasing temperatures worldwide.  This effect is known as ‘global warming’.  

CO² is also produced every time an animal breathes out. Humans naturally breathe CO² in the air all the time, and plants use it to produce oxygen. Most scientists however predict that any more decades of unrestrained burning fossil fuels will lead to melting icecaps, increased droughts and fires, and in a worst-case scenario threaten human societies altogether. 

The NSW Environment Agency wants to know if it has the power, under this Act, to impose maximum levels of emissions of CO², including on everyday activities such as driving cars. Advise the Agency.
