 The Government of India, with an intention to curb the prevailing practice of renouncement of triple talaq by the Muslim husbands, decided to criminalize such an act by Muslim husbands accordingly, the Parliament of India passed the Triple Talaq (criminalization) Act, 2018 inter alia provided that any Muslim Husband pronouncing Triple talaq in its unapproved form shall be liable to be punished with a minimum imprisonment of 2 years and maximum of 7 years apart from paying compensation to the Muslim wife. 6. Taking advantage of this new law, Reshma filed a criminal complaint against wasim and also demanded compensation of Rs.1 Cr. from him. Aggrieved by the action of Reshma, Waheed Mohd moved to the Supreme Court along with other similarly placed Muslim Husbands praying for a declaration that the Triple Talaq (Criminalization) Mt, 2018 is totally unconstitutional and unreasonable and as violative of the right to freedom of religion of the Muslim husband.
