The Queen v Albert
On 12 June 2020 at 4:50pm a robbery took place at a jewellery store located at 231 Birk Street, Melbourne, Victoria. Three men rushed into the store wearing identical black balaclavas, black jackets and gloves, each holding a gun. One man guarded the entrance, while the other two men entered the store and took all of the merchandise and cash, placing it into their backpacks. Five minutes later, all three men left the store and ran into a black car parked outside and drove away in a northerly direction. The owner, Mr Evans, and a customer, Ms Connell, were the only persons present during the robbery.
Mr Silva, the manager of the convenience store next door, heard the disturbance and called the police at 4:52pm. Detective Bell and Detective Carter were assigned to investigate. They arrived at the jewellery store at 5:02pm and interviewed witnesses at the scene. Following the investigation, a suspect, Richard Albert, was arrested and charged on 15 July 2020.

Question 1
Detective Bell keeps a personal log that contains the progress of her investigations which she uses for reference.
On 15 July 2020, Detective Bell made an entry regarding the current investigation: Around 5pm 12 June I arrived at the scene with my colleague Detective Carter. The shop owner Mr Evans appeared physically and emotionally distressed when we arrived. We called an ambulance and later discovered that Mr Evans had suffered a stroke. Consequently, we have not had an opportunity to question Mr Evans as part of this investigation.
I asked my colleague Detective Carter to interview Ms Connell, a customer who was at the scene. She provided a description of the conversation between the three men. According to Connell they called each other ‘Fred’, ‘Maxi’ and ‘Rick’.
I also interviewed Mr Silva at the scene. He stated that the man who stood by the door during the robbery took off his balaclava when he entered the black car, which allowed him to briefly see the man’s face. Mr Silva provided a detailed description to our forensic expert and an image of the suspect has been
put together.
Based on the information provided by Ms Connell and Mr Silva, I reviewed previous similar cases. This led me to suspect that Richard Albert might be one of the men involved in the robbery because:
- He lives less than 5km away from where the robbery occurred
- He is known by the nickname ‘Rick’
- He has been charged with theft and carrying a firearm without a licence in the last 12 months.
- The image provided on the basis of Mr Silva’s description bears a striking similarity to Richard Albert
