The Scenario.

The instructor will post a peer reviewed paper in some aspect of biology. Your team will pretend to be the publishing investigator and describe what it is you would like to patent as it pertains to the study (any real patents filed or issued you will have to treat as prior art but you will not be allowed to duplicate an filed or issued patents). 
Evaluation and Purpose. It is entirely possible that teams will patent different aspects of the study that meet patentability requirements. You will have to clearly explain how your patent concept meets all the criteria, as discussed in the course, for patentability. You may take this further, by attempting to structure some actual patent claims (limit of 8 claims dependent or dependent claims). 
Data Universe for this Assignment. We want to make sure this class exercise does not get out of control by involving too much literature. The data universe for prior art is as follows: 

1. One to three peer reviewed papers (or patents or products) posted by the instructor in Quercus as part of this assignment (in addition to the "discovery paper").

2. General knowledge of science 
The emphasis is on how well you apply patent concepts and argue your case.

You can argue that the patent strategy by the opposing team is invalid due to obviousness, lack of novelty, or other grounds for invalidity that will be discussed in the course. You can also attack their claims.

1. Patent Strategy Submission paper. A one page submission summarizing what the invention or "discovery" is that you plan to patent and your claims.

2. Patent Attack Paper. In this (five - ten pages) paper your team performs 2 basic tasks: put forward a defence of your described patent strategy against likely criticisms you think will be levelled at your team, and attack the patent strategy of the opposing team.
