Task

District Court [NSW] considered whether a cruise ship operator breached its duty of care to a pregnant passenger who had suffered a miscarriage, leading to psychological harm. The Court held that the ship’s doctor had failed to appropriately assess the plaintiff passenger’s risk of a miscarriage and failed to warn her of the risks of taking/continuing the cruise. The court awarded the plaintiff monetary damages.
