U Ko Ko, owner of a small chain of restaurants called Kaung Shal (KS) has hired the business consulting firm (which you now work for) in search for a better understanding on how the law affects his business. He has several situations which you need to comment on. Your goal is to guide him to a better understanding of contract law.

1. His first issue is with a customer named Phoe Toke who came into the restaurant and ordered some food for himself. The food was prepared as ordered and after Phoe Toke finished the meal he started to leave without paying. When U Ko Ko confronted Phoe Toke, Pho Toke said there was no contract and U Ko Ko should try to sue him but he will lose because there was nothing signed. The cost of the food was MMK15000. 

2. There was another, similar, issue with a customer named Johnny who filled out a form online to order food for delivery within 30 minutes. The food was properly prepared and when delivered to Johnny’s address (5 minutes late), Johnny said that he was under 18 so he did not have to pay. The food was returned to the restaurant but by that time it could no longer be sold and had to be thrown away. The cost of the food was MMK 20000.

3. U Htun Myint is the local health inspector and has hinted that he does not think KS is clean enough. U Htun Myint asked U Ko Ko for MMK500,000 he could make sure that all KS restaurants in Yangon would be OK for doing business. U Ko Ko didn’t want to take any chances so he wrote a simple contract as follows:
