Brief
Part A
In this part of the assignment, your group (of two) is to fulfil the roles of Contractor’s Representative as employees of Capital Building Pty Ltd and Superintendent’s Representative as employees of Calbert Consulting Pty Ltd. You are required to administer the construction contract between the Principal and the Contractor on behalf of the Contractor or the Superintendent, as applicable to each question, in accordance with NCW4 General Conditions of Contract for Construction and Annexure Part A and Part B – Commercial Framework included on Canvas for Part A.
Read the attached documentation and correspondence. With each piece of correspondence received, review it with respect to the contract and your role as Contractor’s Representative or Superintendent’s Representative, as applicable, and respond accordingly.
Advising the Contractor that they are wrong and requesting that they resubmit is not an acceptable response as it does not display your full understanding of the problem.
Part B
In this part of the assignment, your group (of two) is to fulfil the role of Superintendent’s Representative as employees of Excel PM Services Pty Ltd. You are required to:

Background Part A
Jamie Developers Pty Ltd (Principal) has decided to construct a new Community Health Centre at 99 Tiny Close in Tingalpa (Project A).
The Principal engaged Jamie Sont to act as the Principal’s Representative during the design and tender phase of Project A. The Principal’s Representative previously arranged for the design and documentation for Project A to be carried out by a consulting team, made up of the architect, engineers, quantity surveyor etc, and has called tenders. The closing date for the tender was Wednesday, 7 February 2024.
The Principal engaged Calbert Consulting Pty Ltd to act as Superintendent for the construction contract for Project A. Calbert Consulting Pty Ltd has appointed Adam Calbert as Superintendent’s Representative for the contract.
The form of contract for Project A is to be a fixed price lump sum contract based on NCW4 General Conditions of Contract for Construction with Annexure Part A and Annexure Part B – Commercial Framework.
Tenders are duly received and the Principal has decided to award the contract to Capital Building Pty Ltd.
Background Part B
Residential Towers Pty Ltd (Principal) has decided to construct a new Commercial Development at 900 Tut Street in Strathpine (Project B).
The Principal engaged Excel PM Services Pty Ltd to act as Superintendent under the construction contract for Project B.
The form of contract for Project B is to be a fixed price lump sum contract based on NCW4 General Conditions of Contract for Construction with Annexure Part A and Annexure Part B – Commercial Framework.
The Contractor for Project B is ABC Builders Pty Ltd.
