Review of the case study

In the majority of sexual assault cases, women are assaulted by their intimate partner. The case study is based on sexual assault in the form of rape by a former partner of a woman. The woman, named Annie took years to understand what happened to her (Pridham, 2023). She was traumatised as she felt violated by her former partner. The rape incident resulted in pregnancy. Annie experienced strong emotional and physical responses during the period of her pregnancy. She faced several nightmares, flashbacks, pervasive thoughts out of control and fear of her former husband what he might do as he was unpredictable. In addition to this, she failed to inform and document the rape case earlier as she failed to have faith in the justice system (Pridham, 2023). She reported the incident so that it could be recorded in the statistics in the belief that to bring the change in the justice system accurate information is required. She was also traumatised by the fear of the backlash from her perpetrator. 

Key issues

The key issues that can be raised from the case study are lack of knowledge regarding sexual assault, when to report, where to report, the benefits of documenting, and the rights of social justice and trauma (Carmody, 2009). As per the Australian Bureau of Statistics data, nearly 87% of women who experienced sexual assault fail to contact the police (Pridham, 2023). In the majority of cases, the failure to document the issue is the lack of knowledge about the process and the faith in the social justice system. Victim-survivors feel that investigation and reporting of the sexual assault might increase the complexity of the situation (Westera et al., 2023). People have a lack of faith in the justice system which gives rise to a failure to document and allow investigation of sexual assault-related cases. Annie asked the police not to investigate the incident as she did not want to impose charges on the perpetrator as she feared the consequences of the investigation. Another issue that is evident from the case study event is the trauma generated by the incident. Annie faced that the justice system failed to correct responses for everybody.

Annie’s situation was devastated due to the sexual assault that she faced and its outcomes such as unprepared pregnancy and trauma generated by the rape incident. She faced emotional and physical responses which she developed due to the sexual assault and her pregnancy which is also one of the negative outcomes of rape. She faced traumatised situations that gave rise to nightmares, flashbacks of the sexual attack and others. Victim-survivors generally weigh up their own mental health against the incident-generated trauma that causes barriers and hinders them from documenting the incidents and going through the proceedings of the social justice system (Herman et al., 2005). People need to make the decision whether dealing with the justice system would be worth it for them (Ali et al., 2019). Annie feared the consequences of reporting and accessing the justice system as well as investigation the issue as the perpetrator is unpredictable.
